By engaging with our services or accessing our Website, you agree to comply with and be bound by these Terms.
1. Change of Agreement
Changes to the agreement require written consent from both parties.
The agreement constitutes the entire understanding between both parties.
2. Communication
All communication between the client and Innov8tech must be in writing, via email, or an agreed project management tool.
3. Content Format
The client agrees to provide all content for the website (e.g., text, images, videos) in an electronic format, organized by page.
4.Third-Party Subscriptions
If any third-party subscription or paid service is required for the project, the client is responsible for covering the associated costs.
5. Bug/Error Resolution
Any bugs or errors caused by development faults will be rectified free of charge.
Bugs caused by third-party software updates or service changes are not covered..
6. Development Time
Development timeframes are approximate and may vary due to technical challenges or client delays.
Delays in providing feedback or approvals may impact deadlines.
7. Hosting Services
Innov8tech is not responsible for hosting-related issues but will assist where possible.
Clients should verify the terms of their hosting provider for support.
8. Email Spamming
Issues related to email spamming depend on the hosting server and mail client. We will assist in resolving issues where possible but are not liable for external server policies.
9. Responding to Queries
We aim to respond to client queries within 24–48 hours, though response times may vary during busy periods.
10. Testing and Checking After Deployment
Clients are responsible for testing their site within 3 months of deployment and reporting any issues.
Post-3-month issues are not covered unless explicitly agreed.
11. Work Revisions
Clients are entitled to 3 rounds of revisions for web and logo design.
Additional revisions will incur extra charges based on work and time invested.
12. Payment Terms
Payments must follow the agreed milestones.
Invoices are valid for 30 days. Work begins with a 20% upfront payment.
Payment for digital marketing services is due monthly.
13. Cancellation Terms
Either party may terminate the contract with prior written notice.
14. Refund Terms
Refunds are not possible once work is completed.
Refund eligibility is evaluated on a case-by-case basis.
15. Ownership & Intellectual Property
Ownership of final deliverables is transferred to the client upon full payment.
The client is responsible for ensuring all materials provided (e.g., logos) are properly licensed.
16. E-Commerce Responsibilities
Clients must ensure their e-commerce site complies with relevant laws.
Innov8tech disclaims liability for penalties or damages related to compliance failures.
17. Governing Law
These Terms are governed by the laws of the State of Victoria, Australia. Disputes will be resolved in Melbourne courts.
18. Test and Deployment Support
Post-deployment support is available for 3 months. Beyond this period, additional support is chargeable.
19. Dispute Resolution
Disputes must first be resolved through negotiation or mediation before legal action.
